Vabalaud.ee Terms of Use

General Provisions

These Terms of Use govern the relationship between the Service Provider and the Users consuming the services provided in the Vabalaud.ee environment.

Terms
Service Provider: Vabalaud OÜ (registry code 11922027), the company managing www.vabalaud.ee and www.tablenow.ee information portals.

Restaurant: Dining/restaurant service provider (juridical person) with whom Vabalaud OÜ has an agreement for managing Reservations (including bars, cafés and other dining establishments).

Customer: A person, who wishes to visit a Restaurant.

Regular Customer: A Customer who has a registered account in the vabalaud.ee environment.

Pending Reservation: A Reservation that is requested by the Customer but not Confirmed by the Restaurant. Reservations are confirmed by the Restaurant according to the terms agreed on and shown on the reservation form. The Restaurant must confirm the reservation manually.

Confirmed Reservation: The place, date and time requested by the Customer and confirmed by the Restaurant, when the Customer can visit the Restaurant according to the terms provided in the reservation. Customers of Restaurants with activated automatic confirmations get a confirmation instantly. Processing of additional information is not guaranteed in case of automatic confirmations.

Visited Reservation: After a Visited Reservation we send an email to the Customer and ask them to rate their restaurant experience. Rating is voluntary.

Paid Reservation: Restaurants can offer their Customers paid products to go with their reservation. A Paid Reservation is recognizable by the “Reserve and pay” button below the reservation form.

Event: An event organized by a Restaurant at a specific time, where it is possible to make a reservation.

Special Offer: An offer from a Restaurant that is valid during a certain time frame, usually a discount or a special menu.

Gift cards: A gift card provided by Vabalaud OÜ, which is valid in chosen Restaurants. Gift Card is a product that ensures the Customer products/services for the amount stated on the gift card during their reserved visit. There is a corresponding field activated in the reservation form for accepting gift cards. One gift card can only be used for one reservation. When the field is missing, the chosen Restaurant does not accept the Gift Card. The conditions for acquiring the Gift Card are described HERE.

Newsletter: The service provider's newsletter is a summary of new members, upcoming events, special offers and other important information about the Service Provider, which is meant for Customers. The Newsletter is sent out 1 to 4 times a month.

Bonus points: With each reservation in the Service Provider’s environment, Regular Customers earn bonus points, which can be used to acquire gift cards. Detailed terms are found HERE.

Shopping Cart: Reservations pending payment are shown on the Shopping Cart page.

Reservation Process
1. Customer opens the reservation form of their desired Restaurant
2. Customer enters their name, e-mail address and phone number as contact information, also the number of people, their desired date and time for the visit. During the date selection, the Customer is shown time selection fields with remarks “Online” or “Queued reply”. This remark indicates whether the reservation is confirmed automatically or they need to wait for a confirmation from an employee of the Restaurant.
3. If a gift card is used, the number of the gift card is to be entered in the corresponding field. The gift card field only recognizes numbers of gift cards provided by the Service Provider.
4. Additional requests can be written in the additional information field, these will be forwarded to the Restaurant upon reservation.
5. The Customer must read and confirm the acceptance of these Terms of Use.
6. The Customer may accept that their e-mail address is added to the Service Provider’s Newsletter subscribers list.
7. The Customer confirms their reservation request by clicking on the “Reserve” button.
8. If the Restaurant supports automatic (online) confirmation, the Customer is given immediate on screen feedback about their successful reservation. Confirmation of the reservation is also sent to the e-mail address provided by the Customer.
9. If the Restaurant does not support automatic confirmation, a message about their pending reservation is sent to the customer’s email address.
10. A reservation can be considered a Confirmed Reservation, if a confirmation letter is received after the Restaurant’s decision.
11. The confirmation sheet of the reservation (and in case of a gift card, the Gift Card itself) is a prerequisite for visiting the Restaurant. The confirmation sheet can be given digitally. The first submission of the confirmation sheet is considered correct.

Paid Reservation Process

4. The Customer must read and confirm the acceptance of these Terms of Use.
5. The Customer may accept that their e-mail address is added to the Service Provider’s Newsletter subscribers list.
6. The Customer confirms their reservation request by clicking on the “Reserve and pay” button.
7. The customer is redirected to the Shopping Cart and can continue to submit the Payment or make another reservation. Paid reservations are pending in the Shopping Cart for 15 minutes. If the reservations are not paid by then, they are canceled and removed from the Shopping Cart.
8. The Service Provider uses Maksekeskus OÜ information system as their payment processing partner.
10. The customer can use the following bank links:
-Estonia: Swedbank, SEB, Nordea, Danske, LHV, Krediidipank, Pocopay and Liisi ID
-Latvia: SEB, Citadele and Nordea
-Lithuania: Swedbank, SEB and Nordea
-Finland: Nordea, Danske, Pohjola, Ålandsbanken, S-Pankki, Säästonpankki and Handelsbanken

11 . In the Maksekeskus OÜ payment form, the Customer can choose from different banks and cards to submit their payment.
12. After a successful payment, Maksekeskus OÜ directs the Customer back to the Service Provider’s website and sends a notice with confirmed reservations by e-mail. The reservation confirmation sheet is sent to the e-mail address provided by the Customer.
13. The confirmation sheet of the reservation is a prerequisite for visiting the Restaurant. The confirmation sheet can be given digitally. The first submission of the confirmation sheet is considered correct.

Personal Data and Processing of Personal Data
• Customer’s email address is not revealed to third parties, except for Restaurants that have been reserved.
• We restrict ourselves to gathering as little information as possible, only what we need in order to provide customers with a high quality service (name, phone and email). 
• After becoming a regular customer, it is possible to change or edit personal data on the Service Provider’s website at any time.
• By making a reservation through the Service Provider, the customer agrees with the use of their personal data for the reservation.
• The Service Provider emails newsletters and offers only when the person has requested it by entering their e-mail address in the website and notifying their wish to receive direct mail messages.
• The customer can discontinue receiving messages from the Service Provider and Restaurant at any time.
• We mostly collect general data about our customers, for example, which page is visited the most. We use this kind of information for statistical purposes. It helps us to determine what our customers are interested in the most and what they need. Thanks to this kind of information, we can improve the quality of our services.

Customer Liability, Rights and Obligations
• By making a prepayment to the Service Provider’s account, the Customer accepts these Terms of Use. 
• The Customer is obliged to provide the Service Provider with only true personal data about themselves.
• Giving up a reserved table must take place at least 2 hours before the time of the agreed reservation. 
• Prepayments for paid reservations are not refundable. The Customer has the right to hand their reservation over to third parties. Upon agreement with the Customer, the prepayment is refunded by the Restaurant.

Service Provider's Responsibilities, Rights and Obligations
• The Service Provider is responsible for ensuring the regular performance of the portal (eg: the Customer's reservation will reach the Restaurant on time).

Restaurant’s Responsibilities, Rights and Obligations
• The Restaurant has the right to refuse service to a customer who doesn’t have a printed out or digital payment confirmation to show.
